Terms and Conditions

Welcome to the game video management and streaming platform operated by www.goodgame.ru. (" GoodGame ") consisting of the web site available at the URL http://www.goodgame.ru and all related services, software applications and networks that allow for the authorized streaming and distribution of game video content over the internet (the " GoodGame Service "). The GoodGame Service also includes any other sites or services that link to these terms and conditions (the " Terms and Conditions "). Other services offered by GoodGame may be subject to separate terms (in which case we will let you what terms will apply to those services).

The following Terms and Conditions for the GoodGame Service is a legal contract between you, an individual user of at least 13 years of age (see section 2 below about minors using GoodGame) or a single entity ("you"), and GoodGame regarding your use of the GoodGame Service.

"Cookies" Information : When you access the GoodGame Service, we may send one or more cookies - small text files containing a string of alphanumeric characters - to your computer.

"Automatically Collected" Information : When you access the GoodGame Service or open one of our HTML emails, we may automatically record certain information from your system by using cookies and other types of tracking technologies. This "automatically collected" information may include Internet Protocol address (" IP Address "), a unique user ID, device type, device identifiers, browser types and language, referring and exit pages, platform type, version of software installed, system type, the content and pages that you access on the GoodGame Service, the number of clicks, the amount of time spent on pages, the dates and times that you visit the GoodGame Service, and other similar information. Depending on the law of your country of residence, your IP address may legally be considered personal information.

GoodGame may offer certain additional services for which you can agree to pay fees to GoodGame. The applicable terms will be made available on the applicable GoodGame web page and will supplement these Terms and Conditions.

The GoodGame Service is not available to persons under the age of 13. If you are between the ages of 13 and 18 (or between 13 and the age of legal majority in your country of residence), you may only use the GoodGame Service under the supervision of a parent or legal guardian who agrees to be bound by these Terms and Conditions. BY DOWNLOADING, INSTALLING OR OTHERWISE USING THE GOODGAME SERVICE, YOU REPRESENT THAT YOU ARE AT LEAST 13 YEARS OF AGE AND HAVE NOT BEEN PREVIOUSLY SUSPENDED OR REMOVED FROM THE GOODGAME SERVICE.

The GoodGame Service is also not available to any users previously suspended or removed from the GoodGame Service by GoodGame (see section 16 below for more about suspension or removal).

The GoodGame Service is owned and operated by GoodGame.ru. Unless otherwise indicated, all Content and other materials on the GoodGame Services, including, without limitation, GoodGame&qout;s logos, the visual interfaces, graphics, design, compilation, information, software, computer code (including source code or object code), services, text, pictures, information, data, sound files, other files and the selection and arrangement thereof (collectively, the " Materials ") are protected by copyright, trade dress, patent, and trademark laws, international conventions, and all other relevant intellectual property and proprietary rights, and applicable laws (including in your country of residence). All Materials contained on the GoodGame Service are the proprietary property of GoodGame or its subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to GoodGame or its affiliates and/or third-party licensors. GoodGame reserves all rights not expressly granted in these Terms and Conditions.

Unless otherwise expressly stated in writing by GoodGame, you are granted a limited, non-sublicensable license (i.e. a personal and limited right) to access and use the GoodGame Service for your personal or internal business use only.

This license is subject to these Terms Terms and Conditions and does not include any of the following: (a) any resale or commercial use of the GoodGame Service or the Materials; (b) the distribution, public performance or public display of any Materials (except for Broadcaster Content by the Broadcaster posting the Broadcaster Content – this is all explained further below); (c) modifying or otherwise making any derivative uses of the GoodGame Service or the Materials, or any portion of them; (d) use of any data mining, robots or similar data gathering or extraction methods; (e) downloading (except page caching) of any portion of the GoodGame Service, the Materials or any information contained in them, except as expressly permitted on the GoodGame Service; or (f) any use of the GoodGame Service or the Materials except for their intended purposes. Any use of the GoodGame Service or the Materials except as specifically authorized in these Terms and Conditions, without the prior written permission of GoodGame, is strictly prohibited and your failure to comply with them may have legal consequences which may include violating applicable laws, including copyright and trademark laws and applicable communications regulations and statutes. Unless explicitly stated in these Terms and Conditions, nothing in them shall be interpreted as conferring any license to intellectual property rights, whether by estoppel, implication or other legal principles. This license can be terminated.

GoodGame reserves the right, at our discretion, to change, modify, add, or remove portions of these Terms and Conditions at any time (for example to reflect updates to the GoodGame Service or to reflect changes in the law). If GoodGame changes these Terms and Conditions, we will provide you notice of these changes, such as by sending an email, posting a notice on the GoodGame Service or updating the "Last Updated" date above. Please check these Terms and Conditions for those changes. Your continued use of the GoodGame Service after the posting of changes constitutes your binding acceptance of such changes. For any material changes to these Terms and Conditions, the amended terms will automatically be effective thirty days after they are initially posted on the GoodGame Service unless you contact us to discuss any questions or comments during that time period. We will always make a reasonable effort to notify you if we do change these Terms and Conditions.

Please note that since we respect game designer, game publisher and other Content (as defined below) owner rights, it is GoodGame&qout;s policy to respond to notices of alleged infringement that comply with the Digital Millennium Copyright Act (the " DMCA "). If you believe that anything in the GoodGame Services infringes upon any copyright that you own or control, you may file a notification of such infringement by e-mail support@goodgame.ru.

In accordance with the DMCA and other applicable laws around the world, GoodGame has adopted a policy that it will promptly terminate without notice any user&qout;s access to the GoodGame Service if that user is determined by GoodGame to be a "repeat infringer." A repeat infringer includes, without limitation a user who has been notified by GoodGame of infringing activity violations more than twice and/or who has had their Broadcaster Content or any other user-submitted content removed from the GoodGame Service more than twice. GoodGame may also at our sole discretion limit access to the GoodGame Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

In addition, GoodGame accommodates and does not interfere with standard technical measures used by intellectual property rights owners to protect their materials.

GoodGame may provide other third party content on the GoodGame Services and may provide links to Web pages and content of third parties (collectively the " Third-Party Content ") as a service to those interested in this information. GoodGame does not control, endorse or adopt any Third-Party Content and makes no representation or warranties of any kind regarding the Third-Party Content, including without limitation regarding its accuracy or completeness. Please be aware that we do not create Third Party Content, nor we do not update or monitor it, therefore we are not responsible for any Third Party Content on the GoodGame Service. Users use such Third-Party Content at their own risk.

The GoodGame Service may include links or references to other web sites or services solely as a convenience to Users (" Reference Sites "). GoodGame does not endorse any such Reference Sites or the information, materials, products, or services contained on or accessible through Reference Sites. In addition, your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the GoodGame Service are solely between you and such advertiser. Access and use of Reference Sites, including the information, materials, products, and services on or available through Reference Sites is solely at your own risk.
